Woman awarded over $200,000 in medical malpractice suit

If you have ever been through surgery, you will know the worry and uncertainty that can precede it. You may also recall the relief when it is all over and the problem has been resolved. But what if the issue was not fixed or if mistakes were made during the surgery? What if the doctors in whom you placed your trust were negligent in their duties and in fact left you in a worse condition than you were in prior to the surgery? Sadly, this is a reality all too many patients in Maryland and the rest of the United States have faced.

In one case, a 72-year-old woman from Maine sued the company responsible for a cataract surgery she underwent. She also sued the company’s two owners. The surgery allegedly was botched and caused one of her retinas to become detached. She was left with blurred vision and can no longer detect people approaching on her left unless she turns her head to face them. She has also lost depth perception in the affected eye.

Her lawsuit was originally filed in 2010, a year after the surgery took place. However, it took until this month for the case to finally be resolved. The defense side contested the suit, claiming that the victim received adequate care. The jury, however, ultimately ended up ruling in the patient’s favor and granting her a monetary award of over $200,000 to cover her suffering, pain, lost benefits, lost wages and medical expenses.

It may have happened in another state, but patients in Maryland can imagine the distress that this woman must have experienced. Surgical errors can result in serious and permanent damage to the patients involved and those responsible for such errors should have to answer for what they did.
