Husband and wife sue over undiagnosed back injury

When you are injured or unwell, you rely on your doctors to determine the cause and aid you in your recovery. At the very least, you do not expect them to make your condition worse. Unfortunately, misdiagnosis of a condition or failure to diagnose it at all can mean that it gets far worse before anything is done about it. In Maryland, as is the case in many U.S. states, all too many patients suffer the consequences of medical negligence.

In Iowa, one couple has sued the state, via University of Iowa Hospitals and Clinics over allegations that they failed to diagnose his spinal injuries. The victim suffered rib fractures, a clavicle fracture and back pain after falling from a roof in 2011. He claims that not only did UIHC not diagnose him correctly, but that the chief quality officer admitted in writing to substandard care on the part of the facility.

The victim now alleges that his back injury is permanent and has sued for medical expenses among a list of other grievances, such as pain and suffering and lost income. His wife has joined him in the lawsuit with one of the complaints being that the incident resulted in the loss of spousal companionship. They are hoping that the matter will go to a jury trial and that they may receive damages.

This may have happened in another state, but patients in Maryland can sympathize with this couple. When conditions go undiagnosed, the effects can be devastating and permanent.
